I'm not sure if I understand your question but
you can set a filter to match any bit-pattern in the TOS (or DS)
field and classify it to an arbitrary class.
filter <interface> <class> 0 0 0 0 0 tos 0x0 tosmask 0xff
will match packets with the TOS field set to 0.
